Terms of Service

1. Agreement to These Terms

These Terms of Service govern your access to and use of Family Memories, available at family-memories.ca, including any family websites, family trees, user accounts, uploaded content, subscription services, custom domain services, and related features.

By creating an account, accessing a family website, uploading content, purchasing a subscription, or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. About Family Memories

Family Memories is a private, password-protected family history and family archive service. It allows authorized users to build family trees, create family member profiles, and upload family-related content such as photos, videos, audio recordings, stories, memories, messages, letters, recipes, prayers, blessings, songs, poems, historical information, family records, and newspaper clippings.

Family Memories is not an official genealogy, legal, inheritance, citizenship, medical, historical, or public-record verification service.

3. Eligibility and Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for all activity that occurs under your account.

You must not share your password with unauthorized persons. If you believe your account has been compromised, contact us immediately at support@family-memories.ca.

4. Family Administrators

Each family website may have one or more selected administrators. Only selected administrators are intended to add, edit, remove, approve, or update family information, family member profiles, events, and uploaded content, unless additional permissions are specifically granted. Administrators may also invite users, remove users, manage permissions, manage billing, and request cancellation or deletion of the family website.

Selected family administrators are responsible for managing access to their family website and ensuring that family information, event information, and uploaded content are accurate, appropriate, authorized, and handled responsibly.

5. Password-Protected Access

Family websites are intended to be private and password-protected. However, password protection does not guarantee complete privacy or security. Selected administrators are responsible for inviting only trusted people and for avoiding the upload of information that should not be shared with invited users.

6. User Content

“User Content” means any information, data, text, photos, videos, audio, files, documents, family tree details, family event information, reunion details, stories, comments, recipes, letters, records, or other materials uploaded, entered, stored, posted, or shared through the service.

You retain ownership of your User Content. By uploading or entering User Content, you grant Family Memories a non-exclusive, worldwide, royalty-free licence to host, store, back up, copy, format, resize, process, display, transmit, and otherwise use the User Content only as necessary to operate, maintain, secure, improve, and provide the service.

7. Your Responsibility for Uploaded Content

You represent and agree that:

  • You have the right, permission, consent, or authority to upload, share, and display the User Content within the family website.
  • You will not upload content that infringes copyright, privacy rights, publicity rights, trademark rights, or other rights of any person or organization.
  • You will not upload illegal, abusive, harassing, defamatory, hateful, obscene, threatening, exploitative, fraudulent, malware-infected, or otherwise harmful content.
  • You will be respectful when posting sensitive family information, including information about living people, children, adoption, separation, divorce, medical history, cause of death, criminal allegations, family disputes, or private communications.
  • You are responsible for the accuracy and legality of family tree information and uploaded materials.

8. Accuracy Disclaimer

Family Memories does not verify the accuracy, completeness, ownership, legality, or reliability of administrator-submitted family information or uploaded content. Dates, relationships, biographies, stories, locations, family event details, documents, and family records are provided and maintained by selected family administrators.

The service is for personal family-history and memory-sharing purposes only and should not be relied upon as official legal, genealogical, medical, inheritance, citizenship, or historical proof.

9. Living Persons and Minors

Users must exercise care when adding information about living people, especially children. You should not add or share personal information about living individuals unless you have appropriate permission, consent, or a reasonable family-related basis to do so within the private family website.

Family Memories may remove or restrict access to information about living people or minors if we believe it creates a privacy, safety, legal, or security concern.

10. Copyright and Takedown Requests

Do not upload copyrighted content unless you own it, created it, have permission, or are legally allowed to share it. This includes professional photos, newspaper articles, poems, songs, scanned books, letters, videos, and historical materials.

If you believe content on Family Memories infringes your rights, contact us at support@family-memories.ca with enough information to identify the content and explain your claim.

11. Prohibited Uses

You may not use the service to:

  • Violate any law or regulation.
  • Access or attempt to access accounts, family websites, servers, or data without authorization.
  • Upload malware, viruses, scripts, or harmful code.
  • Harass, threaten, defame, impersonate, or abuse another person.
  • Collect information about users without permission.
  • Interfere with the security, operation, or performance of the service.
  • Use the service for commercial scraping, spam, phishing, fraud, or unauthorized advertising.

12. Storage, Backups, and Availability

Subscription plans may include storage limits. If a family website exceeds its storage limit, we may require the administrator to delete content, upgrade the plan, or purchase additional storage.

We may maintain backups for security and disaster recovery. Backups are not guaranteed to restore all data in every situation. Selected administrators are encouraged to keep their own copies of important family content.

We aim to keep the service available, but we do not guarantee uninterrupted, error-free, or permanent availability. Maintenance, outages, technical problems, internet issues, third-party provider problems, or events beyond our control may affect access.

13. Subscriptions, Billing, Refunds, and Domains

Subscription, cancellation, refund, custom domain, and domain renewal terms are described in our Subscription, Refund & Domain Policy, which forms part of these Terms.

14. Privacy

Our collection, use, storage, and disclosure of personal information is described in our Privacy Policy, which forms part of these Terms.

15. Suspension or Termination

We may suspend, restrict, or terminate access to the service if you violate these Terms, fail to pay required fees, create legal or security risk, misuse the service, or if we are required to do so by law.

We may also remove or disable content that we believe violates these Terms, infringes rights, creates privacy or safety risks, or may expose Family Memories or others to liability.

16. Limitation of Liability

To the maximum extent permitted by law, Family Memories and 1001591083 Ontario Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, family content, goodwill, or business opportunities arising from or related to the service.

To the maximum extent permitted by law, our total liability for any claim related to the service will not exceed the amount you paid to us for the service during the 3 months before the claim arose.

17. Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.

18. Indemnity

You agree to defend, indemnify, and hold harmless Family Memories and 1001591083 Ontario Inc. from claims, damages, liabilities, losses, costs, and expenses arising from your use of the service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

19. Changes to the Service or Terms

We may modify, suspend, or discontinue parts of the service from time to time. We may also update these Terms. The updated version will be posted with a new “Last updated” date. Continued use of the service after changes are posted means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, unless another jurisdiction is required by applicable consumer protection law.
